WALTHALL, Justice.

We will designate the parties respectively as plaintiff and defendant,- as in the trial court.

Plaintiff, North American Life Insurance Company of Chicago, held a promissory note for the principal sum of $3,000 executed by Pickens Bowen, and also held a mortgage on certain lands in the state of Oklahoma, given to secure the payment of said note. The note and mortgage were executed on January 16, 1920, the note made payable to the order of Gum Brothers Company, a corporation, on the 1st day of January, 1927. The note is made to bear interest.
