This is an action against the Chesapeake and Ohio Railway Company and the Director General of Railroads to re*195cover damages for the death of the plaintiff's intestate, who was killed by a passenger train on the Chesapeake and Ohio Railway on March 31, 1919, while that company was under the control of the federal government and operated by the Director General of Railroads. After the evidence was all in, the defendants demurred thereto and the trial court overruled the demurrer and entered judgment against both defendants for the sum of $8,000, the amount of the damages assessed by the jury in…
