NICKERSON, District Judge:
This ease involves disabled preschool children residing in New York City who claim that they have not received an appropriate education as required by federal and state law.
The Individuals with Disabilities Education Act, 20 U.S.C. §§ 1400-1485 (the Act), mandates that states receiving federal aid develop a plan to provide a free appropriate spe cial education to all disabled students between the ages of three and twenty-one.
