This suit grows out of a collision between the trucks belonging to the respective parties to this lawsuit. The Esso Standard Oil Company sned the Midwest Dairy Products Company for damages to its truck. At the conclusion of the plaintiff’s proof, the defendant not offering any proof, the case was submitted to a jury which returned a judgment in favor of the Esso Standard Oil Company. A motion for new trial was made and overruled, the case appealed to the Court of Appeals.
