MEMORANDUM OPINION AND ORDER

NEWBLATT, District Judge.

Before the Court are several motions pending in the above-captioned matter. Frank J. Kelley, Attorney General of the State of Michigan, filed a motion to intervene as a defendant in this action pursuant to Rule 24(a)(2) and (b)(2), Fed.R. Civ.P. Rule 24(a)(2) states that intervention shall be permitted:

when the applicant claims an interest relating to the property or transaction which is the subject of the action and he is so situated that the disposition of the action may as a practical matter impair or impede his ability to protect that…
