— This is an appeal from a judgment of the circuit court of Clark County incorporating the Mississippi & Pox River Drainage District in said county.
The controversy arose out of a misunderstanding between the landowners and petitioners asking for the incorporation; some contended that they signed the pe*162tition under a misapprehension of the facts, others changed their minds and desired to withdraw their names from the petition and that they he included in an adjoining district, and so informed the court; the remainder were content with the proposed district.
