Plaintiff in error, Fiero Garippo, (hereinafter referred to as defendant,) was indicted in the criminal court of Cook county for the murder of Jeremiah McShea on May 9, 1923. He pleaded not guilty, and upon a trial the jury returned a verdict finding him guilty of manslaughter and sentencing him to the penitentiary “at the discretion of the court.” The jury had not been given a form of verdict for manslaughter and the court sent them back into the jury room to bring in a proper verdict.
