Convicted of murder in the first degree on the ground of extreme atrocity or cruelty in the death of an eighteen month old boy named Donald, 1 the defendant, Albert P. Merola, appeals. The defendant argues that the judge erred in (1) denying the motion for a required finding of not guilty; (2) denying the motion to allow use of confidential Department of Social Services (DSS) records; (3) his evidentiary rulings; and (4) the instructions to the jury.
