On February 21, 1958, John F. Trevino et al. filed in this Court a motion for leave to file a petition for writ of mandamus against the Honorable Ross E. Doughty, District Judge, 38th Judicial District, seeking to require him to enter á final judgment in Cause No. 4796, styled John F. Trevino et al. v. Andres Cardenas and R. S.
