Presently before the Court is Magistrate Judge Carlson’s Report and Recommendation (Doc. 51) to Defendants Warden Ronnie Holt (“Warden Holt”), Wayne Ryan (“Ryan”), and DeShawn China’s (“China”) (collectively, “Defendants”) Motion to Dismiss and/or for Summary Judgment.
