CHRISTIAN, Judge.

The offense is murder; the punishment, confinement in the penitentiary for thirty years.

It was charged in the indictment, in substance, that appellant, with malice aforethought, killed Emery Lee Cox by cutting him with a knife.

The testimony of the State was to the effect that appellant and deceased had had a quarrel a few minutes before appellant assaulted deceased. Again, it was the version of the State that appellant attacked deceased with a knife having a blade about two and one-half inches long, and cut him twice.
