I. INTRODUCTION
The matter came before the Court for trial in the above adversary proceeding in which Stewart F. Grossman (the “Trustee”), in his capacity as both Chapter 11 Trustee of the estate of Robert M. Platt and Trustee of the Nursing Homes Liquidating Trust, seeks, inter alia, a declaration and an injunction against the Boston Red Sox Baseball Club Limited Partner ship (the “Red Sox”) so that the Trustee may sell four (4) season tickets to the Red Sox eighty-one (81) home games for the 2003 baseball season and all attendant…
