Plaintiffs Lorraine Christie (“Christie”) and Contiguous Towing, Inc. (“Contiguous” and together with Christie, “Plaintiffs”) commenced this action against defendants the State of New York (the “State”), New York State Department of Transportation (the “DOT”), Joan McDonald (“McDonald”), Michael Ufko (“Ufko”), Jessica Polito Parker (“Parker”) and Lt.
