Defendants, Frank E. Mazzone and Lockport Theatre Corporation, were found guilty of obscenity in violation of section 11—20 of the Criminal Code of 1961 (Ill. Rev. Stat. 1975, ch. 38, par. 11—20) after a jury trial in the circuit court of Will County. The trial court entered judgment and assessed a $500 fine against Mazzone and $1,000 fine against the Lockport Theatre Corporation in November 1975. The appellate court, in a 2-to-l decision, affirmed in October 1977. (52 Ill. App. 3d 859.) We granted defendants’ petition for leave to appeal under Rule 315 (65 Ill. 2d R. 315) in January 1978.…
