BACKGROUND

This appeal involves a dispute among family members over title to two tracts of land located in Zapata County, Texas, one of which is subject to oil and gas leases. The history of the underlying dispute begins with Manuel Cavazos, Jr. and his wife, Berta Vela Cavazos. In 1959, Berta was declared incompetent, and a guardian of her person and estate was appointed. When Berta died in 1986, her guardian had in his possession the two tracts of land. The property was distributed to Berta’s heirs, one of whom was Berta and Manuel Jr.’s son,…
