Appeal by the defendant from a judgment of the Supreme Court, Kings County (Lipp, J.), rendered March 30, 1992, convicting him of murder in the second degree, robbery in the first degree, criminal possession of a weapon in the second degree, and criminal possession of a weapon in the third degree, upon a jury verdict, and imposing sentence. The appeal brings up for review, the denial of the defendant’s application for hearings to (1) challenge the lawfulness of his arrest and (2) suppress evidence seized at the time of his arrest.

Ordered that the judgment is reversed, on the law, a new trial…
