This suit was brought to recover damages resulting from .very severe injuries received by plaintiff, S. E. White, when struck by an automobile driven by defendant on the beach of the Atlantic Ocean between high and low water marks and within the corporate limits of the Town of Neptune Beach on June 11, 1934. The cause was submitted to a jury, and a verdict was returned in favor of defendant. Plaintiff brings writ of error to this Court.

In the course of the trial the judge of the lower court gave the following charge to the jury:
