This was an action for damages for killing stock, instituted by the defendant in error, plaintiff below, against the plaintiff in error, defendant below. The petition contains three paragraphs. In the first, plaintiff claims the sum of $150 for the killing of a mule; in the second, the sum of $175 for the killing of a horse; and in the third, the sum of $15 for the killing of a calf. The three causes of action are based upon violations of the fence laws of the state by the railroad company.
