This matter comes before the Court pursuant to Defendant Smart Solar, Inc.’s Motion for Judgment on the Pleadings (Doc. # 31), filed on February 20, 2014. Plaintiff Garden Meadow, Inc. filed a response in opposition to the Motion (Doc. # 34) on March 19, 2014. For the reasons set forth below and for the reasons stated at the *1205hearing held on May 28, 2014, the Court denies the Motion.
