The record in this, case is voluminous, and the many questions raised in the pleadings have been presented with great force by counsel in argument.

But- believing, as we do, that there is one single question which is necessarily controlling, it is deemed important to statu in the opinion of the Court only such pleadings and facts as raise and elucidate that question.
