DECISION AND ORDER

WARREN, District Judge.

This action was initiated by plaintiff Betty Lou Falk upon the filing of a complaint against the defendant Falk Corporation on January 3, 1973. The complaint seeks monies in the nature of annual payments allegedly due and owing plaintiff as beneficiary of a deferred compensation plan entered into between her deceased husband, Richard S. Falk, Sr. (hereinafter “deceased”), and the defendant corporation. Thereafter, by order of the Court dated March 1, 1973, defendants Dorothy H. Falk, now known as Dorothy H.
