Pending before the Court is a Motion for Partial Summary Judgment (Document No. 9) filed by Plaintiffs J/0 Ebony K/S and J/0 Management A/S seeking dismissal of that portion of the Defendants’ Cross-Claim that seeks recovery of lost income during the period when Defendants’ dredge ship STUYVESANT was out of service for permanent repairs.
