Affirming.

Owen Sizemore was a deputy sheriff of Harlan county, employed by the" appellant to preserve order at its Chevrolet mine. During the night of December 25, 1931, having been informed by a superior that propaganda of the Communists or an objectionable labor-union was being distributed in the mining camp, he went to investigate it. He was shot and killed while undertaking to evict one of those trespassers from the company’s property.
