Affirming in part and reversing in part.
On December 1, 1916, Jackson Campbell was in the employ of tbe appellant and plaintiff below, feex Coal Company, as a miner at its plant in Harlan county. Both employer and employee had accepted onr workmen’s compensation act, and on that day the employee received an accidental injury arising out of and in the course of his employment, from the effects of which he died fifteen days thereafter.
