This matter is before the Court on plaintiffs’ two motions for summary judgment and defendant’s and defendant-intervenors’ (collectively, “defendants”) three cross-motions for summary judgment in two consolidated cases: American Petroleum Institute v. Johnson, Civil Action No. 02-2247, and Marathon Oil Co. v.
