BRETT, Judge.

This is a special proceeding in this action, wherein Edward Lewis Hudson is plaintiff in error, and the State of Oklahoma is defendant in error. In such proceeding, the plaintiff in error petitions for new bail to be set by this court.

It appears from the record before us that petitioner was convicted in the district court of Oklahoma County, in case No. 26972, and thereafter posted an appeal bond in the sum of $5,000. Such conviction was thereafter appealed to this court.. It further appears that the petitioner’s surety, Doc E. Williams, was released from said appeal bond upon…
