SMITH, Circuit Judge.
Ricky Spaulding worked as an employee of an independent contractor that provided industrial cleaning services to Conopeo, Inc. (“Conopeo”) at its Unilever plant in Independence, Missouri. While cleaning a large tank, Spaulding fell into it and suffered severe personal injuries. Spaulding sued Conopeo, asserting negligence based on a variety of Conopco’s alleged acts and omissions.
