Appeal from an order of the Supreme Court (Teresi, J.), entered June 16, 2005 in Albany County, which, inter alia, granted a motion by defendants David Martin and Michael Martin for summary judgment dismissing the complaint against them.

Plaintiff James Olsen (hereinafter plaintiff) is employed as a police officer with the City of Albany. While working the night shift, plaintiff and his partner responded to a call regarding a fight.
