OPINION OF THE COURT

Scott A. Miller, J.

Defendant, Benjamin Spradlin, moves for dismissal of the misdemeanor information charging one count of criminal possession of a controlled substance in the seventh degree (Penal Law § 220.03), arguing legal insufficiency pursuant to CPL 100.40 and illusory statement of readiness pursuant to CPL 30.30. The court has reviewed the defendant’s moving papers and the People’s responses in opposition thereto, and has analyzed the accusatory instrument on both hearsay and element grounds.
