On September 16, 1946, the parties to this action, Dean M. Burnett, hereinafter designated the plaintiff, and Edwin F. Poage, named hereinafter as defendant, entered into a. contract in which each became the owner of a half interest in a Chrysler sedan motor car for which, from the record, it appears that the money advanced was by the -plaintiff. The car was originally registered in the name of the plaintiff, and the contract contemplated a division of the profits thereafter to be realized.
