Trellis Powell sued Columbus Addison and his wife, Mary *36Addison, for damages for injuries Powell received as a passenger in an automobile driven by Columbus and owned by Mary. Powell’s complaint states he was “a passenger for hire in a vehicle operated by [Columbus], owned by [Mary] . . . when [Columbus] lost control of the vehicle . . .” injuring him. The Addisons claimed “sudden emergency” and unavoidable accident due to sudden brake failure. Powell dismissed his claims against Mary.
