This cause came on for consideration upon the motion of the defendant to dismiss. The court, having considered the record and being fully advised in the premises, finds and concludes that the motion should be granted.
This is an admiralty action brought under the Jones Act, 46 U.S.C. § 688, to recover damages for pain and suffering, loss of society, etc., as a result of the death of Ira Gregory while allegedly in performance of his duties as captain of the motor vessel, Mucho K.
