A. The Parties

CORCORAN, District Judge.

The plaintiff, Trans World Airlines, Inc. (“TWA”) is an air carrier operating under certificate of public convenience and necessity issued by the Civil Aeronautics Board pursuant to Section 401 of the Federal Aviation Act of 1958 (49 U.S.C. § 1371).

The defendant Federal Energy Office (“FEO”) was established by Executive Order No. 11748 of December 4, 1973, (38 Fed.Reg. 33575). Under that Order the President delegated to the Administrator of FEO (i) all the authority vested in the President by the Emergency Petroleum Allocation Act of…
