—Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Plaintiff, a carpenter employed by third-party defendant Frank L. Ciminelli Construction Co., Inc. (Ciminelli), was injured on October 16, 1991 when she slipped and fell on the sloped side of an excavation while checking the condition of a wooden form at the bottom of the excavation.
