OPINION

W. C. DAVIS, Judge.

This is an appeal from a conviction for theft of service over $10,000. Punishment was assessed at ten years confinement.

In ground of error number one, appellant contends that the verdict of the jury is not supported by the evidence, in that there is no evidence to show that appellant intended to avoid payment. We disagree. Lars Linden, a professional pilot in the charter business, testified at trial that he received a phone call from the appellant on December 14,1975.
