Appeal from a judgment of the Supreme Court (Teresi, J.), entered May 11, 1995 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to *837CPLR article 78, to review a determination of respondent New York State Thru way Authority terminating petitioner from his position as a laborer.
