OPINION & ORDER

BERTELSMAN, District Judge.

This is an action seeking declaratory and injunctive relief and damages by certain property owners against the City of Highland Heights. The plaintiffs 1 complain against the designation of a certain area within the City known as Gateway West as part of an urban redevelopment project, pursuant to Ky. Rev. Stat. AnN. § 99.330, et seq.

The matter is now before the court on cross-motions for summary judgment, based on the administrative record. Additionally, the court has personally toured the area accompanied by attorneys for both sides.
