In this proceeding brought for the settlement of the account of the executrix, a determination is sought with respect to a certain claim made not only against the estate, but also in the alternative, against the executrix, individually. Additional issues are raised by objections made to the alleged" failure on the part of the executrix to account for certain assets of the decedent. Furthermore, the petitioner requests a construction of the will resolving the question of whether the general legacies are to be charged upon the decedent’s real estate.
