The appellee, Emmett Richard Colbert, filed his hill on February 15, 1932, against his wife, Anne Elizabeth Colbert, alleging desertion and adultery, praying for a divorce a vinculo and general relief. From a decree deny*396ing the divorce and awarding the custody of the infant daughter to the wife, this appeal was allowed.
