On September 6, 1930, Herbert A. Inman instituted his suit for divorce against his wife, Mae Inman. In his bill *599he alleges as his sole ground for a divorce that his wife had deserted him on or about September 2, 1930. The subpoena summoning her to answer the bill and notice to take depositions were served upon Mrs. Inman in person on September 6, 1930. Mrs. Inman did not enter her appearance in the suit and was not present or represented at the taking of the depositions. On October 23, 1930, the court entered its decree whereby it adjudged that Mrs. Inman had wilfully and without just cause…
