On examining the admitted facts and the evidence contained in the “ Case ” before this Court, it appears that this appellant, Mary E. Walker, was seized of the tract of land described in the complaint in this case; that by proper conveyances the land was conveyed to A. W. Cum*334mings as security for a debt due to him; that when this debt was paid, except the sum of $49.00, by consent of Mary E.
