OPINION

KAUFFMAN, Justice.

This appeal is from an order of the Court of Common Pleas of Philadelphia denying appellant, Larry Miller, relief under the Post Conviction Hearing Act (“P.C.H.A.”). 1

On September 30, 1965, at approximately 11:30 p. m., appellant shot and killed Edward David White in a gang related incident at 53rd and Locust Streets in Philadelphia, and was arrested almost immediately thereafter.
