Appeal from an order of the superior court for Spokane county, Huneke, J., entered March 5, 1917, granting a new trial, after sustaining a motion for nonsuit, in an action for personal injuries sustained through collision with a street car.

Plaintiff brought this action to recover for personal injuries sustained in a collision between one of defendant’s street cars and a wagon driven by plaintiff. At the conclusion of plaintiff’s evidence, the trial judge sustained a motion for a nonsuit. Plaintiff moved for a new trial, and the trial judge, being of the opinion that the motion for a nonsuit should have been denied, entered an order granting a new trial. Prom this order, defendant has appealed.
