C. T. Smith for the use of S. P. Bell brought a suit for the writ of mandamus against Hall County and named persons as commissioners thereof, to require the payment of a judgment in the sum of $250 theretofore recovered by the plaintiff against the county in an action for damages for diminution in the value of the plaintiff’s land by alteration and relocation of a road passing through it. The defendants filed a general demurrer and an answer; after which the case was submitted to the judge for trial without a- jury.
