MEMORANDUM OPINION

BEFORE THE COURT are four motions, three of which are related to the first, a motion for summary judgment filed by Defendant Hess Oil Virgin Islands Corporation (“HOVIC”). HOVIC argues that this action for wrongful death is barred by a release John Der Weer (“John” or “Mr. Der Weer”) signed four years before he died. By signing the release, Mr. Der Weer received a cash payment from HOVENSA, LLC — a joint venture formed in 1999 between HOVIC and Petróleos de Venezuela, S.A. Virgin Islands (“PDVSA VI”) — and released HOVENSA and its affiliates from all claims…
