Reversing.

In this action for damages for personal injuries plaintiff, Thomas Copenliaver, recovered of the defendant, 'Peerless Coal Company, a judgment for $1,500.00. The ,coal company appeals.

At the time of the injury plaintiff was a coal digger and was working in Room No. 6 of-defendant's mine. He had had several years’ experience as a miner, but had been working in defendant’s mine only a few months. In mining the coal he used a pick.
