ON THE MERITS.

ESTOPINAL, J.

This was a suit by plaintiff to have declared null and void for non-execution á contract between him*178self and the defendant for the sale of an automobile and the return to him of two notes for one hundred dollars each, and the repayment to him of the sum of two hundred dollars ($200), paid cash to the defendant for the machine.

Plaintiff’s petition sets forth that on or about Mfareh 27, 1907, he contracted with II. A. Testard (defendant), a dealer in automobiles, to buy a second-hand automobile for the price and sum of four hundred dollars ($400), two hundred dollars…
