This case has been in this court before (see 37 S. C., 8), where all the facts will be found stated. The complaint alleged that it was a coloration doing business in the city of St. Louis, Missouri, and that on or about October 24, 1888, the plaintiff sold and delivered to the defendant on account twenty-five barrels of flour, of thebrand “Victoria,” at $5.05 per barrel, and twenty-five barrels of flour, of the brand “Gem,” at $4.75 per barrel, which the defendant agreed to pay therefor ; that the defendant has paid the freight on…
