The agreed statement of facts herein shows that plaintiff, an Army officer, was on duty at Jeffersonville Quartermaster Depot, Jeffersonville, Ind. pthat he occupied a house in Jef-fersonville. because public quarters were not available, and was paid rental allowance therefor. By proper orders, plaintiff was on duty continuously during the time the Ohio B-iver was in flood, arid, as found by the War Department, was engaged in saving human life and property of' the United States.
