Findings of fact and conclusions of law were in favor of intervener, and the receiver of the Associated Textiles appeals from the order denying his motion for a new trial.
In an action brought against the Associated Textiles, a corporation, by one of its creditors, the court appointed appellant receiver. The receiver gave due notice to creditors to file claims. The time to file claims expired, and thereafter respondent asked the court to be allowed to intervene and file its claim. Permission was granted over the receiver’s objection and exception.
